HolliHouse International Terms and Conditions for Vacation Renting a Property

PRIVACY: HolliHouse does not share any personal information with any third party except with participating managers where guest has specifically booked one of their properties advertised on the HolliHouse International website. HolliHouse may be required to divulge Owner's information upon request or subpoena by a tax jurisdiction. Guest agrees that HolliHouse may from time to time send marketing emails to any guest or inquiring guest in accordance with ICANN laws. Guest may opt out of any marketing email program at any time. Guest agrees that their information shall be transferred and shared to any future acquirer of HolliHouse International.

TERMS AND CONDITIONS BY OTHER MANAGERS: Some properties on the HolliHouse site are managed by other managers in which case their terms and conditions shall apply.

CANCELATION POLICY AND ARRIVAL ACCESS INSTRUCTIONS: HolliHouse has what is generally known as Moderate cancelation policy. Guest may cancel their reservation any time for a full refund up to 30 days prior to arrival. At 30 days prior to arrival your second payment is due unless you have already paid in full. At thirty (30) days prior to arrival the reservation shall not be canceled for any reason. For Airbnb reservations you may cancel your reservation up to 7 days prior to arrival and receive a 50% refund, Airbnb defines this as a strict cancellation policy. Policies may differ on different marketing websites in which HolliHouse has listed properties for rent. HolliHouse offers optional Travel Insurance through Rental Guardian if you would like to protect your reservation at this time. Directions along with other access information will be provided upon receipt of Final Payment and receipt of this e-sign contract. We will then send you complete access instructions and directions on how to get to and access the property via email.

MAXIMUM OCCUPANCCY: Two Toddlers und the age of three can be brought beyond the Maximum Occupants Limit as defined in any listing on any marketing channel. If Guest over occupies the property beyond the advertised maximum occupancy limit, Guest agrees that they will be asked to leave immediately and a penalty of $1,000 shall be charged to Guests credit card on file. Any security deposit shall be forfeited. Should Guest Report that their group size is above the occupancy limit prior to occupancy, HolliHouse shall refund guest in full or allow guest to move to another property with a higher occupancy limit. The new reservation balance may be different and prices are subject to change nightly. HolliHouse reserves the right to cancel the reservation agreement/application if the average guest group members are under the age of 25 or require an additional security deposit.

PAYMENT METHODS: If you have paid by credit card, we will charge your card on file for the remaining balance 30 days prior to arrival. If you wish to make other payment arrangements, you will be required to contact us no later than 45 days prior to {reservations.startdate}. If you prefer to pay your balance by ACH E-Check, PayPal or any other method please contact our reservation department at Guests@HolliHouse.com with your reservation number.

You may also pay for your reservation by check over the phone (ACH) transfer.

RENTAL AGREEMENT: A completed Vacation Rental Agreement is required to be e-signed within 24-hours to hold your reservation. The First Half Payment is due upon receipt. Review and acceptance of the HolliHouse International's Terms & Conditions which is made part of this rental agreement is required before a confirmation will be issued. HolliHouse International reserves the right to cancel the agreement if the majority of guests are under the age of 25 or if guest requires to bring a service animal to the property. In this case, an additional security deposit authorization will be required.

RATES: Rates are quoted on a per night, per week or per month basis as noted. Unless specified, check-in is after 4PM, and checkout by 11AM on the day of departure. Please know that our rates are subject to change at any time prior to making any reservation and that moved reservations may trigger different prices that are different from the original reservation. HolliHouse may grant an early checkin or late departure at its sole discretion for an additional fee of $75.

PAYMENT: Payment of 50% of the reservation is due and this reservation agreement must be e-signed in order to secure the reservation. Payment may also be made in full. Payment of the second 50% amount is due at 30 days prior to arrival. Full payment is due for any reservation made within 30 days prior to arrival. HolliHouse shall automatically charge the guest card on file for balance due at 30 days prior to arrival. Guest may contact HolliHouse at any time to arrange for a different payment method. The payment method and timing of payments may vary on other marketing channels in which HolliHouse advertises the listed property.

TERMS OF USE OF THE PROPERTY: The property shall be in tidy condition upon departure as at check-in. Normal wear and tear excepted. Owner or its agents or Police may enter the property at any time to make repairs, safeguard the property or provide maid service. Guest may cook in areas specifically designated for cooking. Guest must immediately notify Owner or agent of fire or other damage to property. Guest shall be liable for all acts of the family, group, dogs or other persons invited onto the property. Guest may not sublet or assign this rental agreement. Guest shall abide by the House Rules of the Owner, Property Manager, Condominium Association and/or the Booking Agent as provided to Guest. Guest shall not smoke indoors or anywhere outside on the property. Guest shall rinse feet of sand, dirt or snow prior to entering the property. No parties shall be allowed and Guest agrees to keep the Property quiet after 10PM. No catering or loud outside music is permitted without prior consent, additional charges may apply. Guest understands that there are certain inherent risks to person and property located adjacent to a body of water or to a golf course, including the possibility of drowning or being struck by a golf ball.

PROPERTY SPECIFIC RULES: Each property may have its own specific rules included in the Vacation Rental Agreement.

PETS: If the property is listed as "Pet Friendly" Guest may bring up to two dogs to the property for an additional charge of $50 per dog. No other kinds of pets are allowed. If the property is not listed as "Pet Friendly" no pets of any kind are allowed. If pets are brought to properties which are not listed as "Pet Friendly", guest shall be charged a $1000 penalty. Guests who are bringing dogs must abide by the following Pet Rules: All dog feces must be bagged and picked up on the property and surrounding neighborhood. Dogs must be on a leash at all times in properties with adjacent neighbors according to local leash laws. Dogs may not be left inside the property alone at any time unless they are in a crate to be brought by guest. Dogs are forbidden to be on any kind of furniture or bedding. Documented service dogs are allowed in all properties with an additional security deposit. Documentation must be provided to HolliHouse prior to approval of a service dog entering the property.

HOT TUBS/POOLS: Children under 12 are not allowed to use any pool, jacuzzi or hot tub without adult supervision. Guest and other invitees shall use any available pool, Hot Tub or Jacuzzi at their own risk and must bathe or shower prior to entering these amenities to prevent bacterial build up. Guests shall not consume and food or over occupy any Hot Tub Pool or Jacuzzi. Guest acknowledges this can lead to highly accelerated bacteria buildup. Guest shall be charged $200 for excessive or abusive hot tub use which would require the hot tub to be dumped and scrubbed.

GUEST DEPARTURE REQUIREMENTS: Guest shall deliver the property in a tidy condition and agrees to pay for any excessive cleaning charges as determined by "Host" with the credit card on file. Guest is not required to sanitize or deep clean the Property. Guest shall leave any bedding used unmade to assist cleaners in identify beds which have been used. Any trash shall be placed according to the property access instructions. All perishable food items brought by Guest shall be removed by Guest. ALL Keys, HOA Passes, Garage Door Openers or Parking Passes shall be left in an obvious place on the kitchen counter or desk. Any items left behind by Guest are not guaranteed to be found or returned.

ACCIDENTAL PROPERTY DAMAGE PROTECTION PLAN: HolliHouse International offers a built in Accidental Damage Protection Plan on every reservation to cover accidental damages to the Property caused by Guest and their group members. The plan is included in your reservation and pays a maximum benefit of $1,500.00 to an owner for accidental damage to the property only. Guest agrees to at all times safeguard the property and to report any accidental damage immediately to HolliHouse International. Any damage that is discovered, but not reported, shall be charged to the primary card holder on file. Any intentional damage, or damage caused by failure to safeguard the property or parties, will be charged to the primary credit card on file up to $3,000. If, during your stay at a HolliHouse International Property, any group member causes any accidental damage to real or personal property of the Property as a result of inadvertent acts or accidents, HolliHouse shall reimburse the owner for the cost of repair or replacement of such property up to a maximum benefit of $1,500.00 and Guest's card shall not be charged. Damage caused in excess of $1,500.00 shall be charge to the credit card on file. The plan does not cover missing sundries, keys, HOA passes, garage door openers, theft, or damage from illegal acts such as drug use or production. If items are found missing the primary guest's card will be charged for replacement $50 per item missing. Guest understands that the damage protection plan does not cover Guest's personal property. Guest agrees that HolliHouse International nor Owner is responsible for any loss or damage to Guest's personal property during the term of the rental agreement. Guest agrees to bear all responsibility and liability for any damage or injury to all of Guest's property and property of the individuals staying the property including damage from fire, flooding, roof leaks, theft, winter conditions, fallen trees, hurricanes, high exterior temperatures, forest fire smoke or any other cause.

SECURITY DEPOSIT: Some HolliHouse properties require an additional security deposit to be authorized on the primary Guest's credit card. HolliHouse shall authorize the primary card holder's card for the security deposit amount and will be released back to the card holder in full, within two weeks after departure if no damage is discovered. Accidental damage shall be covered by the Damage Protection Plan prior to deducting funds from the Security Deposit. Intentional damage shall be covered by the Security Deposit prior to deducting funds from the Accidental Property Damage Protection Plan.

LIMITATION OF LIABILITY: Under no circumstances shall HolliHouse International or Owner be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, howsoever caused or incurred whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted and including, without restricting the generality of the foregoing as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of services or land accommodations by HolliHouse or by reason of military actions, revolution or acts of God, government agencies, or unforeseen circumstances or events, by any agents, owners, employees, subcontractors, servants or services as substituted; HolliHouse, at all times will act in good faith and use its best efforts to substitute with accommodations or services of a type as comparable as possible to those contracted. HolliHouse will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services. Some activities in which guests engage are especially dangerous and include scuba diving, snorkeling, deep-sea fishing, boating, golfing, swimming, boogie boarding, surfing, hiking, biking and mountain climbing. This list is not all-inclusive, but indicates some of the hazards of vacationing in the area of the Property. Guests may also encounter the following risks: slippery floors and stairs, especially when wet, lanais with spaces between rails (dangerous for little children), precipitous drop-offs on ocean floor, unfenced pools, faulty electrical or plumbing systems, gas BBQ grills, clean/clear sliding glass doors, and dangerous stairs or pathways, Therefore, each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. By booking this Property, you acknowledge that in all events and circumstances, HolliHouse International, its officers and employees shall not be liable. HolliHouse International reserves the right to cancel or rescind any rental agreement if it is found that the Guests are conducting unlawful activities or failure to safeguard the property, not abiding the Home Owners Association Rules, disturbing others by playing loud music, percussion, audio or instruments, or cause any loud or offensive noises, have made any misrepresentations about the nature or size of the group or use of the group or the use of the property or any other misrepresentations or any other way in breach of the rental agreement.

GUEST REFUNDS BY HOST: Guest acknowledges that HolliHouse International is a marketing and reservation service only for Vacation Rental Property Owners. Property Owners are defined as "Hosts" and bear all responsibility for the delivery of the property to sanitized habitability standards and the marketed offering of the property. HolliHouse International does not bear any responsibility as to the condition of the property, or any defect that Guest experiences at the property. Should guest experience a defect at the property which significantly impacts the enjoyment of Guest, Guest shall immediately contact HolliHouse to report any defect. HolliHouse shall render its best efforts to contact Owner to rectify any defect. Guest may request a partial refund on their stay if a significant defect is encountered and not repaired during the in-house rental period. Any refund to guests are decided by the Owner of the property or "Host" and are deemed final. Defects reported by Guest after the departure date will not be eligible for a credit or refund of any kind. Refunds will not be eligible for catastrophes, natural disasters or power outages.

HOLDOVER, ABANDONED POSSESSIONS AND SERVICE OF NOTICES: If Guest stays in the unit beyond the departure date, without written permission, Guest will be a holdover tenant and shall be charged for twice rent under the Rental Agreement on a prorated daily basis for each day Guest is holdover tenant.

MOVING DATES OF A BOOKING: An additional $100.00 administrative fee will be charged by HolliHouse International for any change to a booking after a Confirmation has been issued. Acceptance of any change is subject to approval by HolliHouse International.

NO SUBSTITUTION: Guest may not change their reservation to another property unless the property is deemed defective or uninhabitable by HolliHouse.

HOLLIHOUSE RIGHT TO CANCEL: HolliHouse reserves the right to cancel this agreement if Guests group exceeds the occupancy limit, if guests are under the minimum age requirements, if Guest discloses they they are bringing a pet to a property that is not desginated as "Pet Friendly".

FAIR HOUSING LAW: HolliHouse and Owner shall comply will all Fair Housing Laws.

CATASTROPHIC EVENTS & EMERGENCY EVACUATIONS: Should a natural disaster occur (hurricane, tornado, earthquake, flood, forest fire, tsunami, heavy snow) beyond HolliHouse's or Owner's control which impairs the vacation of Guest, neither HolliHouse nor Owner is responsible for finding alternate lodging for the renter or for the renter's financial losses related to transportation or alternate lodging. There shall be no refunds or credits due to any natural disaster. HolliHouse urges and recommends to Guest to purchase Travel Protection Insurance with Rental Guardian to provide assistance during your stay and financial relief to secure your vacation investment and reduce financial risk. Guest can purchase Travel Insurance at the time of full payment and not beyond that date.

TRAVEL INSURANCE: To protect against losses caused by certain unforeseen events, such as illness, accidents while traveling, flight delays, baggage loss, medical evactuation, death, or natural disasters causing the desire for a refund either partial or in full, HolliHouse recommends that Guest purchase Travel Insurance through Rental Guardian upon complete payment. All persons named in the Rental Agreement are covered for any accident, travel interruption, or medical evacuation under the terms of the rental policy issued by Rental Guardian.
